About BAA/TAA Products

Trade Agreements Act

The Trade Agreements Act (TAA) was enacted in 1979 to govern trade agreements negotiated between the U.S. and other countries. Under the TAA, federal contracts may only be fulfilled by products that are manufactured or “substantially transformed” in the U.S. or in a TAA-designated country.

Buy American Act

The Buy American Act (BAA) was enacted in 1933 and compels the U.S. government to give preference to U.S.-made products in its purchases. To be considered BAA-compliant, products must meet the following two-part test:

  1. The end-product must be manufactured in the U.S., and
  2. More than 50% of the cost of all component parts must also be manufactured in the U.S.
